Entry Period, Eligibility, and Prizes for Multiple Giveaways and Challenges: The rules and regulations in Sections 2 to 7 of this page are in reference to all giveaways and challenges (the “Promotion” or “Promotions”) in the following list in Section 1 of this page. Each Promotion lists its “Entry Period”, “Eligibility” and date (the “Information”) and is referred to throughout the rest of this page. GET FIT THIS FALL Sweepstakes begin November 13, 2023 and ends December 22 (11:59 pm PST), 2023 and is open to residents in all countries where fit52 is available. Sweepstakes is void where prohibited. The prizes hold no cash value. No purchase or consideration necessary.

Prizes for the Get Fit this Fall Challenge:
Receiving a Bronze badge from doing 5 Flash Fit Workouts in the fit52 app earns 1 entry into a draw to win one of ten (10) exclusive prize packs from the Official Carrie Underwood Store. Prize packs include a signed Denim & Rhinestones Deluxe Picture Disc Vinyl, a Denim & Rhinestones Throw, a Denim & Rhinestones Tote bag, and a Bling Tumbler. Receiving a Silver badge from doing 15 Flash Fit workouts in the fit52 app earns 2 entries into the drawer the same prize pack. Receiving a Gold Badge from doing 30 Flash Fit workouts in the fit52 app earns you 3 entries into the draw for the same prize pack. All workouts and days must be accomplished within the promotions stated Entry Period. Max 2 workouts count each day towards challenge goals. Prize winners will be notified through email 2 weeks after end of Sweepstakes Entry Period.

2. Eligibility: The Promotion is FREE to enter. One (1) entry per person unless otherwise specified in the Promotions listed above. The Promotion is open to individuals who are eighteen (18) years of age and older at the time of entry (“Eligible Participant”). It is your responsibility to ensure that you are legally eligible to enter the Promotion under any laws applicable to you in your jurisdiction of residence or otherwise. The employees, officers and directors the Sponsor (defined below) and fit52  (the “Organizer”), as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer and director are not eligible to participate in the Promotion. The Promotion is open in regions where the fit52 mobile app is available for download. The Promotion is void outside the Region(s) specified, or in any country embargoed by the United States, and where otherwise prohibited by applicable federal, state, provincial or local laws, rules or regulations. The Organizer’s computer is the official time-keeping device for the Promotion.

The information you provide will be used for verification of your eligibility to participate in the Promotion. Entries that do not include all the required information and adhere to the Rules will be considered void. The Organizer or Sponsor is not responsible for lost, misdirected or incomplete Entries. The Organizer determines if an Entry meets the Eligibility Requirements and otherwise complies with the Rules. 3. Release of Liability: By participating in the Promotion, each entrant agrees to release and waive any and all claims of liability against the Sponsor, Fit52, Fit in 52 LLC, Carrie Underwood, any other third party prize provider(s), and any applicable third party involved with the Promotion, and each of their respective employees, officers, directors, affiliates, parent companies, subsidiaries and agents (collectively, the “Released Parties”) from and against any and all liability, loss or damage (including personal injury) incurred with respect to the conduct of or participation in the Promotion, or the awarding, receipt, possession, and/or use or misuse of any prize, including any travel related thereto. By accepting the prize, winner(s) hereby agrees to release each of the Released Parties from any and all claims in connection with the Promotion and the award or use of the prizes. The Released Parties are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity, including, but not limited to restrictions on travel, movement, and large gatherings,  (whether or not the action, regulations, order or request proves to be invalid), national emergency, equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, pandemic, viral or communicable disease outbreak, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Sponsor’s sole control. Upon awarding the prize, the Sponsor will have no further obligation to the winner.

Sponsor Liabilities and Responsibilities: Sponsor reserves the right to determine eligibility and all decisions of Sponsor are considered final and binding. Sponsor disclaims any responsibility to notify entrants of any aspect related to the conduct of the Promotion. Participation in the Promotion constitutes entrant’s full and unconditional agreement to, and acceptance of these official rules. Winning a prize is contingent upon the entrant's fulfillment of all requirements set forth herein.All issues and questions concerning the construction, validity, interpretation and enforceability of the Promotion or these official rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of British Columbia.

4. Prizes: See the Promotions list in Section 1 for each Promotion’s specific prize.

5. Agreement to Official Rules: By participating in the Promotion, you fully and unconditionally agree to and accept these Rules and the decisions of the Organizer, which are final and binding in all matters related to the Promotion. Whether or not you receive a Prize is contingent upon fulfilling all requirements set forth in these Rules. The Promotion is subject to all applicable federal, state/provincial, and local laws. Promotions are void where prohibited by law. You have read, understood, accepted, and agreed to be bound by the Privacy Policy set out at https://www.blog.fit52.com/privacy as they may be amended from time to time.

6. Winner Notification: The winner of the Prizes will be notified via Direct Message on Instagram or via the email address provided. The Organizer or Sponsor may require the prize winner to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver and/or IRS Form W-9 (if required by IRS regulations) prior to the delivery of any prize. If the prize winner does not respond to the notification within 3 days, is found to be ineligible, fails to execute the Affidavit or other documentation required by Organizer and/or the Prize is returned as undeliverable, the Organizer and Sponsor may consider such prize winner to have forfeited the Prize, and another prize winner may be selected as time allows. The Prize will be awarded within approximately 21 days of the winner’s complete response to the notification. The Organizer and Sponsor make no warranties with regard to the Prize. The Prize is not transferable and the winner has no right of substitution (in cash or otherwise). The Organizer and Sponsor reserve the right to substitute a prize of equal or greater value in the event of unavailability.

7. Announcement of Winners: The Prize winner’s name may be posted on our website, Facebook, Instagram, and other social networks. The winner will be announced through Instagram within 2 weeks of the contest close. The Prize winner will need to provide their first name, last name, email address, postal address and zip code to the Organizer to allow them to ship the winning prize to the winner with accuracy.

8. Privacy Policy: Any personal information supplied by you to the Sponsor and Organizer will be subject to the Organizer’s privacy policy posted at https://www.fit52.com/privacy-policy . The Sponsor and Organizer will not sell, rent, transfer or otherwise disclose your personal data to any third party. Additionally, by entering the Promotion you understand that the Organizer may send you additional commercial marketing emails regarding the Organizer and its partners, which you may opt-out of at any time.
